By downloading, installing, accessing, or using the Journly mobile application ("Service" or "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User" or "you") and Journly ("we," "us," or "our"). If you do not agree to these Terms, please do not use our Service and delete the App from your device.

Journly is a comprehensive personal journaling and diary application designed to help users maintain private digital journals with advanced features that enhance the journaling experience while maintaining the highest standards of privacy and security.

The application provides rich text editing capabilities with comprehensive formatting options including bold, italics, lists, and various text styles to help users express themselves creatively. Users can choose from multiple pre-designed templates for different types of entries, including gratitude journaling, daily reflection, goal planning, fitness tracking, travel journaling, grief support, and venting sessions.

A sophisticated mood tracking system allows users to record and analyze their emotional states over time, with visual mood indicators that help identify patterns and trends in their emotional well-being. The achievement system recognizes and rewards consistent journaling habits through unlockable badges that celebrate various milestones.

For organization, users can create custom folders to categorize their journal entries by topic, theme, or time period. A powerful search functionality enables users to quickly find specific content across all their entries using keywords, dates, or other criteria. The favorites system allows users to mark particularly important or meaningful entries for quick reference.

Personalization features include extensive background customization options with a wide selection of colors and images. The platform supports multimedia attachments including images, GIFs, and audio recordings, enabling richer, more expressive journal entries. A flexible tagging system provides additional organization capabilities.

From a technical perspective, Journly implements end-to-end encryption using the industry-standard AES-256 encryption algorithm to ensure that all journal content remains completely private and secure. The application adopts a local-first storage approach using SQLite databases on the user's device, ensuring that personal data remains under the user's direct control.

To use Journly, you must be at least 13 years old and possess the legal capacity to enter into these Terms of Service. By accessing or using the Service, you represent and warrant that you meet this age requirement and have the authority to agree to these terms. For users under 18 years old, parental consent is required.

You bear complete responsibility for maintaining the confidentiality of your account credentials, including your encryption keys, and for all activities that occur under your account. You must provide accurate, current, and complete information when creating your account and keep this information up to date throughout your use of the Service.

It is your duty to notify us immediately if you become aware of any unauthorized use of your account or any other breach of security. One individual may not maintain more than one account without our express written permission, and the creation of multiple accounts by the same person may result in account termination.

Journly is built with privacy as a fundamental principle, implementing a comprehensive "zero-knowledge" architecture where we cannot access, read, or decrypt your journal content under any circumstances. All encryption and decryption processes happen exclusively on your device using encryption keys that only you control.

We collect only the minimal personal information necessary for basic account management and service provision. Journal entries, personal thoughts, and all sensitive content are encrypted using military-grade security measures before any storage occurs and are never transmitted in plaintext.

You retain complete and sole ownership of all content you create using our Service, maintaining full control and rights over your personal expressions and data. This includes journal entries, mood tracking data, uploaded images, audio recordings, custom backgrounds, tags, folders, and achievement progress.

You bear sole and entire responsibility for all User Content you create, upload, or share through the Service. You affirm that you own or have proper legal rights to all content you upload, ensuring that you are not infringing on others' intellectual property or privacy rights.

Your content must not violate any laws, regulations, or third-party rights, and must not contain malicious software, viruses, or harmful code. Content must not be defamatory, obscene, abusive, or harmful to others in any way, and must not promote violence, hate speech, or illegal activities.

You may not use the Service for any unlawful purpose or to solicit others to perform unlawful acts. You must not violate any international, federal, provincial, state, or local laws, regulations, or ordinances in your use of the Service.

You must not create content that violates the intellectual property rights of others, distribute malware or harmful software, attempt to gain unauthorized access to our systems, or share your account credentials with others.

Using the Service to harass, stalk, threaten, or abuse other individuals is strictly prohibited. Creating or sharing content that promotes self-harm, suicide, or dangerous activities is not permitted. Engaging in cyberbullying, doxxing, or sharing private information without consent violates privacy rights.

Using the Service for commercial purposes without our explicit written permission, interfering with our servers or network infrastructure, or modifying our software is prohibited. Uploading explicit sexual content involving minors will result in immediate account termination and reporting to appropriate authorities.

All journal entries and sensitive data are protected using AES-256 encryption in CBC mode with PKCS#7 padding, representing the gold standard for data protection. We utilize the CryptoJS library, a widely trusted and thoroughly tested cryptographic JavaScript library.

Each user's data is encrypted with a unique, user-specific encryption key generated through cryptographically secure random number generation. These encryption keys are stored securely using platform-specific secure storage solutions, including iOS Keychain Services and Android Keystore with biometric authentication where available.

Our zero-knowledge architecture guarantees that we cannot access or decrypt your journal content under any circumstances. While we implement industry-leading security measures, you play a crucial role in maintaining the security of your data by keeping your device updated and never sharing your encryption keys.

We strive to maintain 99.5% uptime for our cloud services and infrastructure. The Service is fundamentally designed to work offline, ensuring that your local journal data remains fully accessible even without internet connectivity.

We are committed to continuously improving the Service and may add, modify, or remove features as part of our ongoing development process. We reserve the right to modify these Terms, our Privacy Policy, or other service agreements, but we commit to providing appropriate notice to users before any material changes take effect.

In the unlikely event that we need to discontinue the Service entirely, we provide at least 90 days notice to all users, ensuring you have ample time to export and preserve your data.

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages that may arise from your use of the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you have paid us, if any, in the 12 months preceding the claim.

The Service is designed exclusively for personal use and is not intended for deployment in situations where service failure could lead to physical harm, significant financial loss, or legal liability.

You agree to indemnify, defend, and hold harmless Journly, along with its officers, directors, employees, and agents, from and against any claims, damages, losses, costs, and expenses, including reasonable attorney's fees, that arise out of or relate to your use of the Service, any violation of these Terms on your part, any infringement of third-party rights by you, or any User Content you create or share.

We reserve the right to terminate or suspend your account immediately, without prior notice, if we believe your conduct violates these Terms or is harmful to other users, our company, or third parties.

You may terminate your account at any time by deleting the App from your device and removing all associated data. Upon termination, whether initiated by you or us, your right to use the Service ceases immediately.

Following termination, we may delete your data after a reasonable period in accordance with our data retention policies.

We reserve the right to modify these Terms at any time to reflect changes in our service, legal requirements, or business needs. We will notify users of material changes through the App, email, or other appropriate channels at least 30 days before they take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Lagos Court of Arbitration (LCA). The arbitration shall take place in Lagos, Nigeria, and the arbitrator's decision shall be final and binding on all parties.

You may opt out of this arbitration agreement by notifying us in writing within 30 days of accepting these Terms.

If any provision of these Terms is found to be unenforceable or invalid by a court or arbitrator, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.

These Terms constitute the entire agreement between you and Journly regarding the Service and supersede all prior agreements and understandings, whether written or oral. Our Privacy Policy is a separate document that works in conjunction with these Terms and specifically governs how we handle your personal information.
